Framework for sentence delivery
The similarities in the tenor and dramatic symbolism of the discourse observed in the English and Italian narratives belie a complexity of normative obligations and conventions imposed on the respective judiciary. An appreciation of the legal and policy context of each narrative not only provides clarity to the framework for delivery, but also context to the phenomenology of action. The intention here, therefore, is to provide a guide to the form and substance of discourse, not a definitive comparative analysis of legal praxis in positivist terms. This intention is necessarily circumscribed by the nature of the narrative method.
